Note: These conditions are additional to the conditions that your library uses and to which you have already agreed. By doing so, you accept OCLC's terms and conditions for using Wise Community.

The terms and conditions below (the "Agreement") govern your use of the Wise community service (the "Wise Community" or "Site") provided by OCLC, Inc. ("OCLC"). By using or accessing the Site, you expressly agree to be bound by the terms and conditions set forth in this Agreement and the laws and regulations applicable to the Wise community and the Site. If you disagree with the terms of this agreement, do not use the site and/or its components and delete your account.

1. Proper use of the Wise community

Unless otherwise noted, content on this site is owned by OCLC and/or its suppliers or licensors, and such content and software are protected by United States and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, modify, create derivative works from or publicly display (except for your own non-commercial use) any content from the Site, except in accordance with the terms of this Agreement. You also agree that you will not use any robot, spider, other automated device or manual process to monitor or copy any content from the Site, unless expressly agreed otherwise.
In addition the Site is provided to you for your own use and may not be used for any commercial purpose except in accordance with the terms of this Agreement. For example, you may not perform any of the following actions without written permission from OCLC: use the Site to sell or offer any product or service; use the Site to increase traffic to your website for commercial reasons, such as advertising sales; copy, reformat and display the results of the Site, or display a copy of any portion of the Site on another website. Any use of the Site that infringes the intellectual property rights of OCLC and/or its suppliers or licensors, or is for commercial purposes, will be investigated and OCLC has the right to take appropriate civil and criminal action.

2. Wise community components, username

The components of Wise community include the following:

When creating your profile you will be asked to choose a username. This is the name that will appear with your contributions in the Wise community. This username must be unique within the Wise community (the system takes care of this) and must not be offensive to others and must not contain obscene language. You may not impersonate any other person or institution. Your username should also not falsely give the impression that you represent OCLC, the Wise community, or any affiliated library in any way. On your profile page you can indicate to what extent your data may be shown to others. Your personally identifiable information will be treated in accordance with the OCLC Privacy Statement located at https://policies.oclc.org/en/privacy/privacy-statement.html .

3. Report Abuse

If you believe a Community submission violates these Terms, you can use the Report Abuse button to report it. When a review is reported by enough people, it will be removed (the person in question will not be notified). The 'Report Abuse' button is not intended to indicate that you disagree with the content of a review. This is a disagreement, for which the Site provides a 'Not Helpful' button.

4. User Contribution and Privacy, Violation of Terms

You may only submit content to the Wise community for which you own the corresponding intellectual property rights; You are prohibited from uploading content that infringes on the intellectual property rights of others. If you upload infringing content, you agree to cooperate with OCLC to resolve the matter at your own expense.

When you submit content to the Wise community, unless you specify otherwise, you grant OCLC a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works of, dissemination and display of such content around the world in all media.

Contributions delivered to the Wise Community without expectation of compensation, partnership or acknowledgment outside of the association of the comment with the author in the forum in which it is provided.

Wise community stores your login details (name, address and customer number), which are only used to provide Wise community services. OCLC does not share this information with third parties. However, OCLC reserves the right to use and/or disclose certain aggregated data to third parties. For more information, see the OCLC Privacy Statement.

Your account is linked to your personal library membership. Library account / customer account You may not post any content that is illegal, obscene, threatening or defamatory, infringes the rights of others (including intellectual property rights and privacy rights), is otherwise offensive or objectionable, or contains a political or commercial message, as determined by OCLC in its own judgment.

Next, any legal remedies OCLC may have for your violation of the terms of this Agreement, OCLC and/or your library also have the right, in its sole discretion, to suspend or terminate your access to the Site.

5. Responsibility and continuity of Wise community, not guaranteed

OCLC makes no warranty that the services provided as part of this Site are reliable, accurate, complete, up-to-date or otherwise valid. The information users post on Wise Community is not verified by OCLC and OCLC is not responsible for any errors or omissions in the information provided and no rights may be derived from the contents of the Site. Therefore, the Site is provided "as is" without warranty of any kind and you use the Site at your own risk. OCLC expressly disclaims any warranty, express or implied, with respect to the website or its contents, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement of any right.

6. Limitation of Liability, Keeping Harmless and Indemnification

In no event shall OCLC be liable for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with the use of the Site, even if OCLC has been advised of the possibility of such damages. In no event shall OCLC be liable for any damages.

User agrees to indemnify and hold harmless OCLC and its employees, agents and representatives from any third-party claim arising out of or in any way related to your use of the Site, including any liability or expense arising out of any claims, losses, damages (actual and consequential ), lawsuits, judgments, litigation and attorneys' fees of any kind. In such event, OCLC will notify you in writing of any such claim, lawsuit or action.

7. Miscellaneous

You may not assign this Agreement or any rights or obligations arising out of it, in whole or in part, voluntarily or by operation of law, without the prior written consent of OCLC. Any such alleged transfer by you without OCLC's prior written consent will be void and without effect or effect unless OCLC expressly agrees otherwise in its sole discretion. Notwithstanding anything of this Agreement, for all purposes of this Agreement, each party shall act as an independent contractor and not as a partner, joint venture participant, agent, employee or employer of the other and shall not bind or attempt to bind the other to a contract. If any provision of this Agreement is found to be invalid or unenforceable, that provision will be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remaining provisions will be enforced. OCLC's failure to act with respect to any breach by you or others does not waive OCLC's right to act with respect to subsequent or similar breaches. The failure of OCLC to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. The section headings and sub-headings in this Agreement are included for convenience only and do not limit or otherwise affect the terms of this Agreement. United States law applies to this agreement. OCLC reserves the right to change the terms of this Agreement at any time, which change will be effective immediately upon posting on the Site. This Agreement constitutes the entire agreement between OCLC and you with respect to the subject matter hereof.
